By participating in this webcast/webinar (hereinafter the “event”), hosted by SmarterChains S.A. (hereinafter the “Company”), you automatically agree to authorize recording of audio and visual content presented during the event and consent to subsequent use of the recording by SmarterChains or any Sponsor or co-Sponsor of the event, where applicable, for Company’s marketing purposes. The audio and visual recording of the event may include documents and materials exchanged or viewed during the event, questions asked and survey and poll answers provided by you during the event, a transcript of the recording and the chat box transcript (hereinafter the “Content”).

1. Cost

The event is provided to you free of charge.

2. Registrations

Registrations are opt-in. Anyone interested may submit an online registration form and register to the event. Attendance is for use by the registrant only and registration information should not be forwarded on to third parties; doing so may hinder your own access, as event entry is by prior registration only.

3. Sharing Content

The Company may share Content with the event’s registrants or attendees, by sending it to them via e-mail. Hence, registrations may still be processed for post-viewing of the event. In addition, recording of the event may be published on the Company’s website – http://www.smarterchains.com - and other media (e.g. Company’s blog) or social media of the Company or elsewhere, at the Company’s discretion.

4. Access to events recordings

We will endeavor to allow uninterrupted access to your event material/recording, but access may be suspended, restricted or terminated at any time. We reserve the right to change, modify, substitute or remove without notice any information in the material from time to time. You are allowed to share such recordings, but you are obliged to always credit the Company upon such sharing.

5. Participants’ personal data

Personal information provided by you either at registration or when you log-in to attend the event are not shared with any third-party, apart from the event platform we use, which acts as our processor, where necessary, for the sole purpose of enabling it to operate and deliver the event service and with which the Company has an agreement prohibiting disclosure of this information to others, unless disclosure is necessary due to legal obligations. In particular, in connection with the operation of the event, you will requested to provide the Company with information that personally identifies you or allows the Company to contact you when you register for the use of the event service. The Company may subsequently use such contact details to provide you with material related to the event.

When sharing Content (for instance, with other participants or when publishing any recordings), the Company shall remove any personal identifying information to protect your privacy. The Company may only disclose your field of industry. At the conclusion of the event, the event audio and video recording, registration and attendee info are stored at Zoom’s cloud, an operating environment that employs reasonable security measures and that is not available to the general public and where only authorized access by certain authorized users of the Company’s staff is permitted. Zoom may process such Content only upon the Company’s request and only for the purpose of technical support.

Please note that upon enabling the recording of the event, you will receive a pop-up notice which requires a participant to click a “continue” button to acknowledge notice of the recording.

If you do not wish to consent to the audio and video recording of the event, please contact info@smarterchains.com prior to the web-event date, or you may simply choose to leave the event during its performance.

In addition, please note that the Company may have enabled Attention Tracking feature, which is operational only when the Company, as host, is sharing its screen. This feature indicates only to the host when Zoom is not the active window on the participant’s computer for more than 30 seconds. The Company shall notify all participants in advance if this feature is in use. Neither the Company, nor Zoom can see or access any other applications on a participant’s screen or computer.

6. System requirements

Web-event participation may require you to configure your software settings on your web-device upon first use,or require you to download the software for your operating system. As aforementioned, the Company uses Zoom as its event platform. Hence, you will be required to download and run this application on your device in order to access the event. For more information, please visit Zoom’s Terms of Service. Please note that you may require administrator privileges on your computer to be able to manually install software.

7. Guests

Please note that, from time to time, the Company may include professionals from various industries as guests in the presentation of an event (hereinafter the “Guests”). These Guests may be independent professionals or may represent a Sponsor. We do not share any of your personal data with such Guests.

If any Guest wishes to cancel or postpone its participation in the event, the Guest should submit a cancellation/postponement request at least one working day prior to the event’s scheduled date. Such request will only be accepted, if agreed to in writing by the Company.

8. Sponsors

If you are a Sponsor, you may appoint a participant at the event. Sponsor hereby states and guarantees that i) it has notified its participant about the identity of the Company, the purpose of the processing of personal data in relation to the event and all other information required by applicable data protection laws and ii) it has obtained any and all required consents regarding the processing of personal data with regard to the event.

9. Guests’ personal data

The Company processes Guests’ personal data for communication purposes related to the the realization of the event and the Guests’ performance in it.Please note that the event will be audio and video recorded and maybe live broadcasted through web streaming. The Guests hereby give their consent to such personal data processing. They understand that they have the right, as data subjects, to access data relating to them, to be informed about the existence and the extent of data processing, to rectify incorrect personal data as the case may be and to oppose further processing on serious and legitimate grounds. Guests can freely withdraw their consent at any time. In that case, all processing operations that were based on such consent and took place before the withdrawal of consent remain valid. Publication of the recording might be on a publicly available website or on an access restricted site or on other media or social media of the Company or these of a third party. If any Guest does not agree with his/her image or voice being recorded, please use the possibility to opt out. To exercise these rights, please contact the Company at info@smarterchains.com. In case the Sponsor’s participant withdraw his/her consent prior to the launching of the event, the Sponsor should notify the Company and replace him/her with another participant, with the Company’s prior agreement.

10. Participant Cancellations and Substitutions

You may choose to cancel your registration without prior notice. Please note that your registration for a scheduled event cannot be transferred to other individuals. You are requested to protect your log-in credentials/log-in link regarding the event from any unauthorised use and to keep them secret. Responsibility for the confidentiality and security of event registration information and event materials issued by the Company lies with the registrant. If you believe that a third party has obtained details in an unauthorised manner, please promptly notify the Company.

Substitutions may be made at any time provided the Company is notified 48hours prior to the event.

11. Cancellation by SmarterChains SA

All reasonable efforts will be made to ensure that the events take place on the announced date and time. On rare occasions it may be necessary to cancel the event due to unforeseen circumstances. In such cases, the Company shall re-schedule the event on the earliest date possible. If for any reason it is not possible to re-schedule, you will be notified accordingly.

12. Event Programme and Speaker alterations

All programmes and presenters are notified to you upon registration at an event. However, due to unforeseen circumstances, occasionally it is necessary to make alterations to presenters/speakers and programme content. If so, you will be notified accordingly.

13. Services offered through the event

The Company, as host of the event, may from time to time decide to provide you access to its services/products, while participating in a event, upon logins provided for the need of workshops. Such services may include a mini assessment of the factory you represent or access to the SmarterChains HUB, the Company’s product, through which you may invite others to participate in the event. Certain services can only be provided to participants that already are or represent Company’s clients, or upon prior payment of relevant services fees. In such case, you will be notified in advance.

In addition, please note that an event may be performed for educational/training purposes, depending on its object and participants, for instance for the training of the Company’s clients. In such case, any Content shall be processed only for educational/training purposes.

Moreover, please note that you may be requested to participate in certain surveys or poll questions during an event, pursuant to the Company’s legitimate interest. In such case, please note that no personal data will be processed. Such activities may include only processing of anonymised data. Any answers, results or assumptions derived from the survey/poll shall be processed for statistical purposes only.

14. Intellectual Property/Copyright

The copyright in the material contained in the events and their recordings, together with the design, text and graphics and all software compilation belong either to SmarterChains SA or to their rightful owners, where applicable. All material prepared and/or used by the Company. including designs, diagrams, drawings, films, software, (electronic) files, etc. shall remain property of the Company. None of this material may be reproduced or redistributed without the Company's written permission or unless otherwise stated in this notice. Unless otherwise agreed, any Content shared is for your own personal, non-commercial viewing and use only. No intellectual property rights are transferred in nay way and the Company retains full and complete title to the event recordings, as well as all the intellectual property rights therein. You may not sell, distribute, reproduce, copy publish or make known to third parties, or convert in any way, any of the Content. All rights are reserved. All trademarks, service marks, graphics and logos are trademarks or registered trademarks of the Company or of other third parties and you may not copy or use them in any manner.

The Company retains the right to use all the knowledge acquired through the events for other purposes, insofar as no confidential information is brought to the knowledge of third parties in doing so.

When participating in an event, Guests grant the Company a licence to publish the audio and video recordings and web streaming.

15. Third-party services

During the events, you may use third party services (for instance, YouTube, etc.). If you decide to enable, access or use third-party services, be advised that your access and use of such other services are governed solely by the terms and conditions of such other services, and the Company does not endorse, is not liable for, and makes no representations as to any aspect of such other services, including, without limitation, their content or the manner in which they handle data (including your data) or any interaction between you and the provider of such other services. You irrevocably waive any claim against the Company with respect to such other services. The Company is not liable for any damage or loss caused or alleged to be caused by or in connection with your enablement, access or use of any such other services, or your reliance on the privacy practices, data security processes or other policies of such other services. You may be required to register for or log into such other services on their respective websites. By enabling any other services, you are expressly permitting the Company to disclose your data as necessary to facilitate the use or enablement of such other service.

16. Limitations of Liability

The Company shall use reasonable endeavours to ensure that the data in the events and their recordings is accurate and to correct any errors or omissions as soon as practicable after being notified of them. The Company will never be liable for indirect damage including consequential damage, loss of profit, loss of savings and damage due to operating bottlenecks. The Company is not liable for the non-functioning or only partial functioning of the internet network, as well as for technical faults due to which the recordings cannot be viewed temporarily. The Company is not liable for the consequential damages due to the non-functioning if the required hardware and software does not function in part or fully, due to technical reasons or in case of programming faults of the manufacturer. The Company is not liable if the required software cannot be installed, or if the software contains a virus or programming error if any, even if the software works or has worked well on other computers.

To the extent permitted by applicable law, the Compay disclaims all warranties and representations (whether express or implied) as to the accuracy of any information contained in the events and their recordings. The Company does not guarantee that the Content will be fault free and does not accept liability for any errors or omissions. The Company does not give any warranty that the website or registration form are free from viruses or any other malware, which may have a harmful effect on any technology or device that you use. The Company is not liable if a fault arises due to injudicious or improper use, or if, without the written consent of the Company, you or third parties have made changes or have tried to do so, to the Company’s product, or have used the same for purposes for which the product is not intended.

17. Links to other websites

A link to another website does not mean that the Company endorses or accepts any responsibility for the content or use of such websites and the Company is not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein. The Company makes no representation whatsoever regarding the content of any other websites, which you may access while logging in or attending the events. Furthermore, the Company is not responsible for examining or evaluating, and does not warrant the offerings of, any businesses or individuals or the content of their websites. The Company does not assume any responsibility for the actions, products, services, and content of any other third-parties. You should carefully review the legal statements and other conditions of use of any website which you access through a link from our website. Your linking to any other off-site websites is at your own risk.

18. Applicable law/Jurisdiction

This notice is governed by the laws of Greece. If any dispute may arise with regard to this notice, competent courts shall be the courts of Athens, Greece.
